TERM
This Agreement is entered into by Parent and New Jersey Institute of Nature for 10 months only and shall terminate upon the Child's completion of same.*

FIELD TRIPS
Parent shall be notiﬁed of all ﬁeld trips in advance and unless Parent submits a written notice that the Child is not to participate in such ﬁeld trips. Parent shall be deemed to have consented to the Child's transportation to and from, and participation in, such ﬁeld trips. Parent recognizes that all ﬁeld trips are voluntary in nature and the Child is not required to attend. Parent waives any and all claims against New Jersey Institute of Nature and its employees for injury, accident, illness or death occurring, during or by reason of the ﬁeld trip, except any such claims which arise out of the willful misconduct or gross negligence of New Jersey Institute of Nature.
ENTIRE AGREEMENT
This Agreement constitutes and contains the entire agreement and understanding of New Jersey Institute of Nature and Parent and sets forth all promises and covenants made by or on behalf of each party to the other party, with respect to the Child's admission in New Jersey Institute of Nature. Each party to this Agreement acknowledges that no representation, inducements, promises or agreements have been made by either party, or anyone acting on behalf of either party, which are not contained in this Agreement for the purpose of inducing that party to execute the Agreement, and each part acknowledges that this Agreement has been executed only in reliance upon such promises and representations herein. No other agreement, statement or promise shall be valid or binding.
MODIFICATIONS
Neither this Agreement nor any term or provision thereof may be waived, modiﬁed or amended, except by written agreement, signed by both parties and even then only to the extent set forth in such written instrument. Any purported oral modiﬁcation of this Agreement shall have no binding, force or eﬀect.
NOTICES
Any notice required by this Agreement to be given to either party may be eﬀected by email or by ﬁrst class mail, and shall be deemed communicated as of the date of receipt.
BINDING EFFECT
This Agreement shall inure to the beneﬁt of and bind the successors and assigns of New Jersey Institute of Nature and shall be personally binding on and inure to the beneﬁt of the heirs, executors, administrators, successors and assigns of Parent.
INDEMNITY
Parent will indemnify, save harmless and defend New Jersey Institute of Nature from all liability from loss, damage or injury to persons or property in any manner arising out of or incident to the performance of this Agreement, including without limitation all consequential damages.
BINDING ARBITRATION
Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, which exceeds $1,500, shall be completely determined by ﬁnal and binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association in eﬀect at the time the demand for arbitration is made, or as otherwise agreed to in writing by the parties, provided, however, the arbitration shall be conducted by a single neutral arbitrator ("Arbitrator") and the Arbitrator shall have no power whatsoever to render an award (a) which rewrites or ignores the plain meaning of this Agreement, and/or (b) which is not in respect to the interpretation and construction of written instruments, including without limitation the proper and lawful use and application of the Parol Evidence Rule, and/or (c) which includes any punitive or exemplary damages. By voluntarily agreeing to this exclusive binding and ﬁnal dispute resolution procedure, the parties agree they are giving up their rights to discovery and to a court or jury trial. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
ATTORNEY'S FEES
If any legal action or arbitration is necessary to enforce the terms of this Agreement, the prevailing party shall be entitled to reasonable attorney's fees in addition to any other relief.
CHOICE OF LAW
This Enrollment Contract shall be construed in accordance with the laws of the State of New Jersey, with venue of any arbitration or litigation to be in Somerset County, New Jersey. Should any provisions be stricken, the remaining provisions shall remain in full force and eﬀect. This Enrollment Contract may only be modiﬁed in writing by mutual agreement of the parties.
MISCELLANEOUS
Parent agrees any and all photos taken while child is a student may be used by New Jersey Institute of Nature in any of its publications.
PARENTAL AUTHORIZATION TO CONSENT TO TREATMENT OF MINOR
I the undersigned, Parent of the child mentioned above, a minor, do hereby authorize any employee of New Jersey Institute of Nature, as agent for the undersigned to consent to any x-ray, examination, anesthetic, medical, or surgical diagnosis or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or special supervision of, any physician and surgeon licensed under the provisions of the Medical Practice Act on the medical staﬀ or any hospital, whether such diagnosis or treatment is rendered at the oﬃce of said physician or at said hospital. It is understood that this authorization and consent is given in advance of any speciﬁc diagnosis, treatment, or hospital care being required and is given to provide authority and power on the part of any employee of New Jersey Institute of Nature to give speciﬁc consent to any and all such diagnosis, treatment or hospital care which a physician, in the exercise of his or her best judgment, may deem advisable. I hereby authorize any hospital which has provided treatment to the above-named minor pursuant to surrender physical custody of said minor to any employee of New Jersey Institute of Nature upon the completion of treatment. This authorization and consent shall remain eﬀective until revoked in a writing delivered to New Jersey Institute of Nature.
TERMINATION
Under certain circumstances, it may be necesssary for the Administrator to decide to discontinue a child’s attendance. Every eﬀort will be made to correct the problematic situation before a ﬁnal decision is made. Termination of enrollment may be the result of the following: • Non-payment of tuition • Abuse of property • Continued violation of NJIN policies • Disruptive or dangerous behavior • NJIN's inability to meet the student’s needs Whenever possible written notiﬁcation of one week will be provided to the parent in the event of termination of enrollment.

We require one month’s written notice prior to withdrawal from New Jersey Institute of Nature.
